For the purpose of these Terms of Service, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on Platform by providing data while registering on the Platform as Registered User. The term "Golazo!!","We","Us","Our" shall mean Golazo!!.
 

These Terms of Service (“Terms”) are a contract between you and Golazo!! located at Kharadi, Pune They govern your use of the Golazo!! App, Websites, Services, Products, and Content (“Services”).

Golazo!! is the owner of the website domain at https://www.golazo.co.in/ and mobile application “Golazo!!” on various App stores.
 

By using Golazo!!, you agree to these Terms. If you don’t agree to any of the Terms, you can’t use Golazo!!.

We can change these Terms at any time. By using Golazo!! on or after that effective date, you agree to the new Terms.
 

 I.  User Account, Password, and Security:

If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform. You agree to immediately notify Golazo!! of any unauthorised use/breach of your password or account and ensure that you exit from your account at the end of each session.
 

II.  Content rights & responsibilities

By scoring matches and events on Golazo!!, you give us a non-exclusive licence to publish them on Golazo!! platform (website, apps, etc.) including anything reasonably related to publishing it (like storing, displaying, reformatting, aggregating, and distributing it). In consideration for Golazo!! granting you access to and use of the platform, you agree that Golazo!! may enable advertising on the platform, including in connection with the display of your content or other information. We may also use your content to promote Golazo!! and sell premium features by aggregating, normalising and enriching your scores.
 

 III. Our content and services

We reserve all rights in Golazo!! look and feel. Some parts of Golazo!! are licensed under third-party open source licences. As for other parts of Golazo!!, you may not copy or adapt any portion of our code or visual design elements (including logos) without express written permission from Golazo!! unless otherwise permitted by law.

You may not do, or try to do, the following:

·   access or tamper with non-public areas of the Services, our computer systems, or the systems of our technical providers;

·   access or search the Services by any means other than the currently available, published interfaces (e.g., APIs) that we provide;

·   forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive, or false source-identifying information; or

·   interfere with, or disrupt, the access of any user, host, or network, including sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of content or accounts in such a manner as to interfere with or create an undue burden on the Services.

We may change, terminate, or restrict access to any aspect of the service, at any time, without notice.
 

 IV.  User Conduct and Rules on the Platform:

You agree, undertake and confirm that Your use of the Platform shall be strictly governed by the following binding principles.

·       You shall not host, display, upload, modify, publish, transmit, update or share any information which:

o   belongs to another person and to which You do not have any right to

o   is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever

o   is misleading in any way

o   involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming"

o   promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous

o   infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorised disclosure of a person's name, email address, physical address or phone number) or rights of publicity

o   contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page)

o   provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses

o   contains video, photographs, or images of another person (with a minor or an adult).

o   tries to gain unauthorised access or exceeds the scope of authorised access to the Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users

o   interferes with another USER's use and enjoyment of the Platform or any other individual's User and enjoyment of similar services

o   infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products

o   violates any law for the time being in force

o   threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation

o   shall not be false, inaccurate or misleading

o   shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers

o   which may cause annoyance and inconvenience and abuse any policy and rules of the company and interrupt or causes to interrupt, damages the use by other Users of Golazo!!.

·       You shall not use any false e-mail address, impersonate any person or entity, or otherwise misleads Golazo!! by sharing multiple addresses and phone numbers or transacting with malafide intentions.

·       You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform. We reserve Our right to bar any such activity.

·       You shall not attempt to gain unauthorised access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, password "mining" or any other illegitimate means.

·       You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.

·       You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and all regulations. You shall not engage in any activity which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.

·   The Content posted does not necessarily reflect Golazo!! views. In no event shall Golazo!! assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Platform. You hereby represent and warrant that You have all necessary rights in and to all Content which You provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libellous, tortious, or otherwise unlawful information.
 

V.  Incorporated rules and policies

By using the Services, you agree to let Golazo!! collect and use information as detailed in our Privacy Policy. If you’re outside the Republic of India, you consent to letting Golazo!! transfer, store, and process your information (including your personal information and content) in and out of the Republic of India. By using Golazo!!, you agree to follow these Rules and Policies. If you don’t, we may remove content, or suspend or delete your account.

 VI. Use of Intellectual Property

By using the Services, you agree to provide Golazo!! with all permissions and rights necessary for the limited use of your Intellectual Property including, but not limited to, your Trademark, Trade Name, Logos, etc., towards the provision of the Services.
 

VII.  Termination:

Golazo!! may suspend or terminate your use of the Golazo!! or any Service if it believes, in its sole and absolute discretion that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms or anyway otherwise acted unethically. Notwithstanding anything in this clause, these Terms will survive indefinitely unless and until Golazo!! chooses to terminate them –

·   If You or Golazo!! terminates your use of the Platform or any Service, Golazo!! may delete any content or other materials relating to your use of the Service and Golazo!! will have no liability to you or any third party for doing so. However, your transaction details may be preserved by Golazo!! for purposes of tax or regulatory compliance.

·   Golazo!! may unilaterally terminate your account on any event as mentioned in the Terms under the point no. IV User Conduct and Rules on the Platform.

·   If You use any false e-mail address or use the portal for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company or mislead Golazo!!  by sharing multiple addresses and phone numbers or transacting with malafide intentions then Golazo!! reserves the right to refuse access to the portal, terminate accounts including any linked accounts without notice to you

VIII.  Disclaimer:

You acknowledge and undertake that you are accessing the services on the Platform and transacting at your own risk and are using your best and prudent judgement before entering into any transactions through Golazo!!. We shall neither be liable nor responsible for any actions or inactions of sellers nor any breach of conditions, representations or warranties by the sellers or manufacturers of the products and hereby expressly disclaim any all responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between You and the sellers or manufacturers of the products. We further expressly disclaim any warranties or representations (express or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products listed or displayed or transacted or the content (including product or pricing information and/or specifications) on Platform. While we have taken precautions to avoid inaccuracies in content, this website, all content, information (including the price of products), software, products, services and related graphics are provided as is, without warranty of any kind. At no time shall any right, title or interest in the products sold through or displayed on Platform vest with Golazo nor shall Golazo have any obligations or liabilities in respect of any transactions on Platform.
 

 IX.  Miscellaneous

·       Disclaimer of warranty. Golazo!! provides the Services to you as is. You use them at your own risk and discretion. That means they don’t come with any warranty. None expressed, none implied. No implied warranty of merchantability, fitness for a particular purpose, availability, security, title or non-infringement.

·       Limitation of Liability. Golazo!! won’t be liable to you for any damages that arise from your using the Services. This includes if the Services are hacked or unavailable. This includes all types of damages (indirect, incidental, consequential, special or exemplary). And it includes all kinds of legal claims, such as breach of contract, breach of warranty, tort, or any other loss.

·       No waiver. If Golazo!! doesn’t exercise a particular right under these Terms, that doesn’t waive it.

·       Severability. If any provision of these terms is found invalid by a court of competent jurisdiction, you agree that the court should try to give effect to the parties’ intentions as reflected in the provision and that other provisions of the Terms will remain in full effect.

·       Choice of law and jurisdiction. These Terms are governed by Indian Laws, without reference to its conflict of laws provisions. You agree that any suit arising from the Services must take place in a court located in Pune, Maharashtra.

·       Entire agreement. These Terms (including any document incorporated by reference into them) are the whole agreement between Golazo!! and you concerning the Services.

·       Grievance Redressal - Any discrepancies or grievances with regard to content and or comment or breach of these Terms shall be taken up with the designated Grievance Officer as mentioned below via in writing or through email signed with the electronic signature to:

Any issue raised with the designated Grievance Officer shall be acknowledged within seventy two (72) hours (excluding weekends & public holidays) of raising such issue. Golazo!! will resolve the grievance within one (01) month of the original communication.
